I'm going to guess that the same folks in the Tea Party screaming about the deficit will somehow find this breaking news to be irrelevant. Of course, they also think the sky's the limit when it comes to spending on immigration enforcement. So much for being consistent. I'm in France until Sunday and blogging from my iPad. My friends wife applied for h1b and left for India on march 30th, while on H4, they got their h4 stamped april 5th, and still dont know about status of h1b application. The i94 number mentioned in the I129 is the old I94 which was surrendered at port of exit. When they reenter sometime in may, she will get new I94 , which will of course, be valid exactly as the I94 mentioned on I129.
1. Will there be any other problem in port of entry , as she will be entering on H4 stamping.
2. Will the h1b application get rejected or queried.

Whatever your priority date and who applied for you ( was it your brother/sister?) is what you will be checking whether they are checking your case yet or not. Here is the web and look at the latest month Visa Bulletin (http://www.travel.state.gov/visa/bulletin/bulletin_1360.html)
I am doing 245i myself. I send I485 for AOS in late Sept, 2010. Had fingerprints done on Nov 3rd. I haven't heard anything from them since October so I dont know if everything is okay.

I have a question; my girlfriend came to the US with a tourist visa in 2002 (now her visa is expired), so now I guess she is an ilegal alien, my question is: Is there anyway she can become a legal resident?

My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?
Given a situation, one way to dust a file is to send the medical with a cover letter.

:confused: I got very anxious when my co lawyer told me that I got a query from INS.
I recently transfered my H1 to current employer and started working for him. Even I got receipt number. When I last tracked the number in INS web site it says mail has been sent out asking for more information.
Company lawyer told me to produce all my paystubs ever since I started to work in US.
I am wondering will this cause any issue. Is this a normal procedure ?
Please help me, if any has any kind of information. Please share with me. My Id madhyastha@yahoo.com

I got this mail today saying the pledge failed to meet its target of 100 people. Only 88 signed up for the pledge :mad:
I think we need to start another drive as we have more members now and we are very close to the lame duck session. Any suggestions???

Please help me out on this.
My employer provided me with substituion LC with PD: Oct 2002, EB, and filed an I140 using it last year. The RD on it is Nov 2005. The 140 had 2 RFEs both asking for submission of original LC. As per the attorney the original LC was submitted with the application, and the attorney requested the CIS to get the copy of LC from DOL, as per the regulation as she says. Now this week CIS as send a denial on this case.
My questions are:
1. The attorney says, she can no longer get the duplicate of the LC from the DOL, as it's an old substitution case. Is there any other way, or solution on this?
2. The origianal LC was filed along with the I140 petition. Is that usual? Should all the originals must have been submitted only on request?
3. Is there any way to make this case alive again? What are the chances of approval if we reopen the case.

If you are having the valid visa, there is no need to go for stamping again. While entering you can show the H1B approval so that you get the I94 till the date on the H1b approval.

1. Does the business necessity need to show how the job duties match the course work during MS or why the job duties are needed for the company?
2. Do we need to send the business necessity at the time of applying for PERM or only when audited.

I have a 3year degree in Bachelors of Science (Maths) and a 1 year degree in BS in Computer Information systems from Golden Gate University in (San Francisco, CA). However at the time of my GC filing, my lawyer advised me that i cannot file for EB2 but for EB3, since my bachelors degree does not evaluate to a 4 year US degree (based on the single source rule). So i had to file my I-140 in EB3.
Recently i read an article on murthy.com http://www.murthy.com/news/n_combdg.html this article clearly mentions that the person I-140 was denied by USCIS but the AAO overturned the case. I asked my lawyer about this, she says that even thought the person had two degree, they were from the same university, but from my understanding ethiraj college is an autonomous university.
I have a feeling my case is similar, what do you'll think i should do..
