I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129 and I worked part-time on a full-time LCA and I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.
Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?
Please advise.

My EB3 I140 got approved in June2008. I am planning to convert EB3 to EB2 and preparing to apply labor through EB2. If EB2 labor got denied, is my EB3 I140 still valid? Do i get a RFE if apply for I485 using EB3 I140? Any Lawyers please..

Hello,
I'd like to know can a dependent (not the prime applicant) on a pending 485 status, avail unemployment insurance, especially the extended benefits which are being given by Federal govt. to the states.
This is the latest from USCIS :

it says, that unemployment compensation is not public charge.
Does it even apply to both standard unemployment insurance and the extended benefits.

I have not gotten my H1 stamped since i have received my work authorization. Can i still get my H1 transferred or do i need to get it stamped and only then can i have my H1 transferred.

I gave first FP on 9/28 and lat month I took info pass and the officer raised a SR for non delivery of cards to which I got a reply that my card might have lost in mail. I called USCIS who mentioned that my card was never created and now it will be created. Now my online status changes mentioning that I have been sent FP notice again. I called uscis again and mentioned that I already gave biometrics
The officer said it was erroneous so ignore the FP notice and he will be requesting CPO for me. I even called FBI FP line today to confirm that my first FP was fine and they said it was fine and uploaded

I received a status update email from USCIS yesterday on my wife's pending I-485 application. The status says "On November 5, 2007, the post office returned the notice we last sent you on this case I485 as undeliverable�.
The status used to say "application is pending" as recently as a week ago. If some notice had indeed been returned to them, wouldn't the status have changed around Nov 5, 2007? Could this be an erroneous online status change? We completed our FP back in Oct 2007. we have received EAD, AP, etc. on our address properly, and haven't moved.

yes. Select it, then check out the left hand panel. I believe that "layout" will have a check box which says, "show object" or something similar. This is what you use to make an object transparent.

Here's another article discussing the embarrassment that is CNN's Lou Dobbs Tonight. I am thinking of applying for 485 right now, and 5 months later for my wife. Do the dates have to current when I apply for my wife. or it does not matter. Has any one done this where they applied for 485 when dates were current but for spouse at a latter date when the dates were backlogged again.
