Supposed my I-485 was approved, am I legally required to go to USCIS, surrender my I-94 card and get a I-551 stamp? Could I just wait for GC to come in the mail?

The card is taking just a few days to arrive these days. Just wait for a few more days. You need the I-485 approval notice to get I-551 stamp.
But I'm sure you won't need it.

Hi,

I have filed for my I-485 application (based on a approved I-140) in July 2007. At that time I also filed for another I-140 based on a substitute labor that I got which had a earlier priority date.

Now that new I-140 that I filed with substitute labor is approved. I am looking at possibility how I can use this new I-140.

I heard there is something called changing underlying I-140 application. Can someone explain this and tell me how I can use it in my case please.

Hi,
I got my PERM labor approved yesterday, for applying I-140 were can I find the processing dates for I-140? I mean specific to Country? Because, if I go to https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=NSC the processing time for "Skilled worker or professional" is April, 1 2008, does this date apply for all? Friends : I meant to start this thread for updates pertaining to applicants whose applications are receipted from NSC, TSC and other centres, but still waiting to recieve their finger printings notices, EAD cards and advance parole too.

Hi All,
One of my friend has been working for a desi company for 6 months and now is moving to another company.

In the desi company offer letter there is no information regarding leave encashment and it says that he is eligible for one day leave per month.
There is no statement regarding leave encashment policy in the offer letter

So if he resigns now will he get any leave encashment or is there any virginia state laws governing the leave encashment

EB-485 processing times in NSC is FOUR (4) Months for the visa number available cases, and also pending EB-485 cases whose visa numbers are current and ready to adjudicate . So does this mean that cases with PD's not current but ready to adjudicate will get their I-485 approved by 6 months . Can some one please break it down for me .

By the ways, there is also a possibility to request retaining old priority date, without filing a second 485.

I assume this is just a request letter from attorney or any representative, if they didn't act on it follow-up with a Service Request.

There has been an error in the processing of my I-130 petition for my mother. It was approved and now I am being asked to submit form I-485 or form I-824. The problem is that my mother is not and has never been to the US. I called CIS and talked to a representative about the error. She said she would send a letter to the CIS about it and that I should hear back from CIS in 5 days. I am just wondering if this timeline is realistic or I should expect it to take more time. Should I contact my senator and ask for assistance in facilitating this process? Would hiring a lawyer expedite this process? I know that the petition should then go to the NVC. Would a lawyer help?

My daughter has joined in a medical program in India and she has to return to US after 4 years to continue her studies. Her 485 is in process and she has stamped H4 upto 2012 ( 3 years from now). I am trying to find out the best strategy to get her here after 4 years if we dont get GC prior to H4 stamping expiry.
Should I continue to apply her EAD and Advance parole whenever she visits US (She will come to US atleast once every year)? Or Can I apply for her EAD and Parole just before the expiry of her h4 stamp (That is after 3 years)? Please advise.

I and my wife are on h1. I want to come on her h4. She recently applied for h1 extension as her employer is nonprofit org and has some policies of his own, he files every year. She filled in may�09 and got receipt number, as the case is still pending who we can apply for h4 now. Is there any way around to apply for my h4 while the case is still pending?
