I think yes you can as far as you have valid copy of your I-140 approval new employer can start the process and you can port the priority date.

I meant Papu..We have not yet heard from IV Core..I know funds may be an issue to do hard lobbying..can we use soft campigning like letter and Fax campign to turn attention to the legal issue..I thought it was time to pick up momentum now..

All,
I wonder if more of you have noticed this phenomena: one of your applications gets approved, but the approval doesn't show up on the online case status system.
My AP was approved on Sept 17, 2007 and mailed out to my attorney who got it in a few days and told me about yesterday when I emailed about another issue. Oddly enough, even today (Sept 27), the online case status system shows an LUD of Sept 14 but no approval. I didn't get the usual approval email from the case status system either.
Annoying -- since now I won't learn of new developments till my lawyer calls me up to let me know and you know what slackers they can be. Although all this may be moot since apparently I am stuck waiting for my name check to clear, so there won't be any new developments to look look forward to for a long long time. Sigh. :(

I am filing 1-140 and 1-485 together by myself based upn EB-2 ( national interest waiver ) category.
Would any one of you please tell me what I should check Part 2 where it ask " I am applying fr adjustment f permanent status based upon"-- If I choose 2(a), then it ask for copy of approval notice.
Any body has any comments.

:confused: I came in US on 15 Oct 2006. The company A who had filed my H1 was not able to arrange a job for me till 5-Dec-06 & they were not paying me as well. So I contacted company B & they arranged a project for me & I started working for them & I am being paid by company B from 11-Dec-06 & company B started my H1 transfer without paystub. Now in this case my H1 transfer will approve or not.

Hi,
I am in a situation where I changed my Job and new organization has filed the Visa Transfer process on 28 May 2010.
My and my dependents current H1-B / H4 and I-94 from the prior organization is expiring on March 14 2011 and the H1-B Transfer process has not been completed and rather it is now in the RFE Status as of Today i.e March - 7 2011.
Am I still eligible to stay in US or not. What should be my next course of action.
Please suggest at the earliest.

Last month dates were 7 Jan 2005.
This month dates are 22 Jan 2005.
Still the reported Jan 2005 approvals(, IV ) etc are less than 5.
Not sure whats happening to these

A new poll from ABC News shows a seemingly contradictory result. Nearly six in ten support the controversial Arizona law SB1070. That will make the Tea Party crowd happy. But the buried headline is that almost the same number support legalizing illegally present immigrants. Why the seemingly conflicting data? I filed in EB2 catagory through company A ( small size company )based on future employment

I am currently working with company B ( Multinational ). My current status is 5th yr H1B ending in Oct 07..Current employer ( Company B ) has finally approved to file PERM labor..
I am struggling to decide if I should file I-485 with company A awail the current dates and at the same time continue to file PERM in next couple of months with company B..
Would it creat any legel wrangling later on?
I am already in my 5 th yr of h1B with company B and there is no guaranteed job opportunity with company A..
Appreciate if any one in the forum could help resolve my situation.

I have applied for family based GC above 21 yrs old on December 2006 and also currently holding h1 valid from October 2008. I also have my opt till May. Now since my employer was not able to find me a project he wants me to chg my status. I do not know what to do and how to chg my visa as, if I go on student visa I need to show financial documents and since I have not made any money how is it possible . If you can also suggest some schools who will not charge much or some courses which are not very expensive and time consuming and also where I can get work authorization as I will find jobs which are not technical and in line with my educational and work qualification . I have a deadline this evening as my employer just called me and told me this

I have a last pay check through an Employer A of August 1, 2008. Earlier before leaving Employer A I filed a H1 transfer to a new employer B and that got approved by USCIS but I didn't start working with Employer B. Now I am getting a new offer from Employer C which is better than Employer B. Attorney of Employer C says that he can file for a transfer through company A as the pay check is less than two weeks.
Now my problem is I not sure whether my transfer from A to C would be successfull or not?
Another thing I have not informed Employer B that I will not be joining him, Do I have to pay him all the H1 transfer fees?

Trying to help Mother-In-Law over from China for visit. Unsuccessful w/ tourist Visa process, so now going for Green Card. Received Notice of Decision against me, unable to establish my Petitioner wife is daughter of Beneficiary Mother-In-Law. No hospital records. Previous evidence was "Notarial Certificate of Relationship." I have just received new evidence "Notarial Certificate of Birth" from civil authorities - along with affidavit from school teacher - I need to file EOIR-29, I think to call it APPEAL, OR IN THE ALTERNATIVE, MOTION TO RECONSIDER - can anyone provide a "go-by" as to what format my letter should take? Is letter format acceptable or is formal pleading format needed?
Time is of the essence, I have to file within 24 hours or give up and pursue DNA testing....

the format of employment date should be "mm/dd/yyyy", or just 'mm/yyyy'?
my last day in my previous employer was a Friday 5/15/2009 and my attorney entered 5/17/2009 (Sunday) as my last day on the LCA coz my first day in my current employer was 5/18/2009.
I am asking my former co-workers to write experience letter for me. Should I let them write '5/15/2009', or '5/17/2009' or just '5/2009' on the letters?

My husband's labor was filed in the end of June, no response yet. It was much faster for me in 2006. I would also like to know if anyone got a response.
