Hello Gurus ,
I am looking for H1 Transfer with 4 months left in H1 six year limit .I lost my job 10 days back.I have approved I-140 but its has not been six months yet after approval .I have not yet filed 485 .
Will I qualify for 3 year H1 extension based on my approved I-140 .?

YOu should go ahead and file your response to RFE. I had the same issue with my case when my attorney did not inform me of a RFE. After missing the deadline, I filed my repone through a different attorney explaining the problemand USCIS accepte my response.

I hear from multiple sources that a concurrently filed 485/140 with 140 in premium is the fastest way to process.
Does this make sense ?
It could be as 485 does not have a A number till 140 is approved.
Once 140 is approved, then have to open the corresponding 485 and enter that information and proceed with its processing ????
So I believe this one is faster than even the approved 140 case submission of 485 ?
Any comments ?

According to the National Center of Health Statistics, just 7,760 mothers report that they live outside the US of more than 4,000,000 births each year. Trying to use my EB3 date in the EB2 category
Just spoke to an IO at TSC, She told me that the case is at a place what they call "Pending Review and final decision"
I asked her whats the next step after this?
IO : Hope fully will be assigne to some one
I Asked, isn't this the place where all the cases are "Pending Review and Final decision"?
IO: a big NO...no no..this is not the place where all the cases are, I can't provide anymore info then this, I was just being nice because you called at 3:30 pm.
Any body who has thier case in the pool of "Pending review and final decision".
Honestly, I think its just a general status that she told me about my 485 case.

seems to say that as long as you have a valid visa (which a greencard is a physical manifestation of an immigrant visa) then you should be ok.
Assuming your son is a US Citizen - he won't need one either.

depends on state law, WA state does not consider H4 as a resident, just found out a month ago, when my wife finished all the tests and everything else and found she had to pay non resident tuition. So she decided not to go to school. CA considers H4 as a resident provided all other criteria are met.

I heard that if the filing of the 140 /labor /485 (any of them) have the filing date < 1 year at the end of the 6 year of h1b then I can not extend my H1B for the 7th year.
Questin: Is this correct?
Details:
Filled labor in june 2007.
Filled 140 /485 in aug 2007
6th year H1B completed in feb 2008.
Question: Am I eligible for the 7th year h1b extension?
If yes then for how many years of extenstion I get?
If not then please suggest what to do.
Note : I have not changed my employer since last 3 years.

my company also got acquired recently and i had gone for stamping. Mine was for renewal. they just looked at the 797 and gave the stamping. i had written the name of the old company in the ds-160 as the h1 document was in their name
