I have an H1B approval from USCIS, and I am trying to go to Canada for the initial visa stamping. But then i have a problem. I initially entered the country as a visitor, and married a citizen, but only after my I-94 had expired for about a week. (My petition is still pending. The company I am working for could not wait for my greencard, since its already been years since I started that process, so they went ahead and applied for the H1B visa for me). I heard that it is a problem to do the visa stamping in Canada if you have been out of status before. Is it advisable to go to Canada for the visa stamping?

On 10/01/09, President Obama signed a continuing resolution to fund continued federal government operations through October 31, 2009. Included in the legislation were provisions to extend the E-Verify, Religious Worker, Conrad 30 and EB-5 programs.
The continuing resolution was attached to the FY10 Legislative Branch Appropriations bill (H.R. 2918), and was passed by the House of Representatives on 9/25/09 and the Senate on 9/30/09.
The E-Verify, Religious Worker, Conrad 30 and EB-5 programs have all been extended for an additional 30 days, though all they may be extended further in the coming weeks once the Senate and House conference the FY10 Homeland Security Appropriations bill (H.R. 2892).

I and my wife are on h1. I want to come on her h4. She recently applied for h1 extension as her employer is nonprofit org and has some policies of his own, he files every year. She filled in may09 and got receipt number, as the case is still pending who we can apply for h4 now. Is there any way around to apply for my h4 while the case is still pending?

I read in one of the threads (couldn't locate it now) where USCIS asked for the financials from the new employer in an AC21 case. So just be prepared.

Labor, I140 approved and I-485 filed during July-07. Have EAD and AP but never used it. Still on H1B, extended for 3 years based on approved I140 and valid until Dec 2011. With my GC employer all along, employer is applying for LCA now as my new client is located in different state. My questions are:
Whether there will be any impact on my ongoing GC process if the job description on this new LCA is different?
If anything goes wrong with this LCA, whether there will be any impact on my existing H1 and eventually on GC process?
If something wrong happens to my H1, can I still switch to EAD after that?
What is the process to move from H1B to EAD within the same company, is filing new I-9 with EAD detail is suffice?
Thanks

Hi All,
Can any one give me what is the usual time frame given to respond to an RFE for I 140. I have seen in various threads that it is usually 12 weeks.
On Feb 22nd, I got an RFE on my 140 and the letter reached attorney's office on Mar 6th. On the RFE letter, USCIS has asked to repsond by April 7th. That is hardly 6 weeks and 4 weeks from the data I recd the letter. Is this usual?

It was an interesting place to celebrate turning 21 with your best friend.....
It was around 50.... such is the demise of the US dollar.....
