Hi All,
I have got an RFE for my I-485 application. . I missed to complete a question (part3 and question #10) in I-485 form for which I got a request for evidence letter from USCIS. Can anyone has any template on how i should reply. Your help is much appreciated . Thanks in advance

Question # 10: Are you under a final order of Civil Penalty for violating section 274C of the immigration and Nationality Act for use of
fraudulent documents or by fraud or willful misrepresentation of a material fact, ever sought to procure, or procured, a visa, other documentation, entry into the United States or any immigration benefit.
Therefor submit an affidavit with your answer to this question a 'Yes' or 'No' response.

With a newborn at home, this was a crucial decision for me, if I used EAD (with same employer) I could work minimum hours like 10-20 hours a week. I just wanted to be sure that at the time of GC processing, my less hours worked shd not be taken as an objection.

I had applied for an EAD and AP renewal in April 09. While I received my EAD and AP at the end of April 09, the EAD case in CRIS was still showing "Initial Decision".
Today I got a random email from CRIS saying that my EAD case is in post-decision activity and that they mailed my card in April 09 (DUH!!!).
When I go to check my cases in CRIS, my 485, EAD, AP from last year and AP from this year all show a soft LUD on 12/3/10.
Does this mean I have been preadjudicated? Or is this just a random event? Or does it mean dark clouds ahead???????

I am sure others might have noticed that 485 processing dates at NSC (for example) have literally crawled from the beginning of the year to now. Here are the processing dates (per USCIS status).

Thats roughly 9/10 days worth of 485 processing from mid-Jan to mid-Jun 2008. I wonder what the processing date looks like for the mid-July status update (which should probably be out tomorrow).

I'm looking to travel to Puerto Rico for a few days in July for my honeymoon but both my green card and passport have both expired. I have been in the US since 1988 and don't travel aboard very often so I overlooked this issue.
I have been told that I can travel to Puerto Rico with just a valid driver's license but don't want to take a chance of having them ask me for my passport and green card and then not being allowed back in the country. I would think that if they ask me if I'm a resident alien, they woudl want to see a non expired green card. I assume it is too late to go through the renewal process for both with just a few weeks left before my trip. I would love to know if I need to go through the renewal process for my passport, green card or both in order to fly to Puerto Rico or if I should just stick to US states.

Hello gurus,
My H1 expires in march 2009, I have valid EAD and AP, I want to renew my H1to be on the safer side.
My wife made use of her EAD for few months and now she is not working, and we are planning to visit India for few weeks next year and get H1 and H4 stamped.
here are my questions:
1. Can my wife get her H4 extension when I apply for my H1 extension ?
2. Does USCIS know that she used her EAD (Is there a way that they can find out) and will there be any problem in approving H4 extension ?
3. Now that she is not using her EAD, Is she back on H4 status ? She came here as H4 and never made a trip back.

My PERM was approved in 3 days filed on June 15, 07 approved on June 18. .
I was lucky to be able to apply I-140, I-485 together during the July madness.
Last Month I received an RFE on the I-140 for degrees and reference letters after sending I-140 approved in 2 weeks. Now I have received an RFE on my I-485
They have asked for work authorization for the volunteering and internship I did while on F1. My atty by mistake put these on the G325A form. The internship was a cpt recorded on the I-20 so no worries there. Volunteering was where the problem is. It was working at a physicians office (my dad's office) helping in computer stuff.
What do the Gurus recommend I do. I am worried that at this stage What can we do.

This is such an open ended question. It will be very easy to answer if you can add few lines about your background, affordability and qualification(like GRE etc). If not the school names will be all over the place from MIT to the ABC University....as the word "Good School" is very subjective.

Hi guys,
MY H1b extn is due in November.But as my marriage will be in May or June i need to go to india.My employer says he can file h1 Extn only before 6 months of expiry.
My question is cant he file for H1B extn before 6 months.
Can I file for extn and leave to india while H1 extn is under process.
If i file under premium are there any disadvantages for it and how long it will take for it to approve.
The only reason iam planning to file h1b in 2-3 months from now is i dont have last 2months of paystubs as i was on vacation and other reason is my current project may be done in may or june.
So please advise me what is the best way to deal with the situation.

I am filing L1B extension and H1B Change of Status at same time
Situation 1) My L1B Extensions paper with (I94) comes prior to H1B change of status paper (with I94),

I was checking the http://congress.org
I noticed they have a Calls to Action from Groups and Organization on the home page, When i tried to see if there are any Immigration related issues posted There were many like increasing H2A etc but nothing corresponding to Retrogression or GC waiting faced by thousands of immigrants.
There are 100s of bills waiting for Co-sponsors published on this website.
I felt we should do post about the issues faced by Thousands of Legal immigrants who are struck in retrogression or Per country limit.
This may be a good place to put as a number of representatives may view it and it is a good way for us to let the people know of the issues.
Any thoughts........

Q. Will the payment I receive in 2008 reduce my 2008 refund or increase the amount I owe for 2008?
A. No, the Stimulus Payment will not reduce your refund or increase the amount you owe when you file your 2008 return.
