    Dear Sakthisagar

    As you said that you applied for H1 extn in 2009 and got extended only for 1 yr instead of 3 yrs [as your I-140 was approved], this means that this yr if suppose you have to apply for H1 extn again that means again the employer has to pay around 4000$ for extn and your have to pay again around 500$ for H4 extn correct ?

    There is no doubt about NRIs are the prime reason for the real estate boom in India. It is tottally unbelivable that 2 bedroom flat in a normal second class town has gone to up to 40 lakes. Decent independent houses are in terms of crores in small cites. Two factors. One is foreign money and second in black money from local dadas/politicians. Also demand vs supply. The availble land is small and demand for that land is too high due to these two gropus.

    I visited one of my NRI friends house in India, where he is not going to live as he is a US citizen. His parents already won two houses and they bought another house as a investment. This house in a recent development area in a small town where there is no high tech employment is avialable; In my feeling it may not worth 5 lakes; they were selling at 45 lakes. Even if anyone ready to pay 45 lakes there is no unit is avialable; everything was sold to NRIs. No resident won the houses in that area. All the dads and mos are baby sitting the houses. Renting alos not that easy. It is tottally unbelivable. I wonder why all the NRIs buying house in India and increisng the house price? The guys working here (or any part of the world) and not going to live in India, why government should allow to buy the house and increse the price? Everyone tries to do real estate bussiness there. That is the main reason for price increase.

    Is is sad. All these NRIs are going to learn a very valuable lesson. Speculation is not a good strategy for investing. A lot learned that in the past few months here in USA. In a year we will be seeing the full blown post bubble correction in India. If one can rent an apartment for 15,000 why would one buy it for 50 lakhs. The interest alone on 50 lakhs is 50,000 every month. It is like buy and rent it and loose money. Instead why don't they deposit in a bank and get 50,000 every month:confused:

    Please don't think as if the IV guys walk in and talk and there you go.... the change is in effect.

    First of all why do U wanna ask that? Its an employment based visa that ur GC is based on. So, ur employer shud ask that. Why are u asking IVans to do something which is not in their control??? I keep getting red and dont mind if I'm banned. But excuse me...u r misleading IVans. My point is this. We can protest, rally based on the delay. Thats pretty much we can do.     I485 is an individual application. It has nothing to do with the employer even in the EB cases. The basis for I485 can be an EB I140. USCIS is answerable to the employer for I140 and answerable to the immigrant for I485. However, I don't think you have the mental capability to understand this obvious law.

    Immigrants don't get to vote and may not have other rights such a welfare, social securicty etc. But USA as the greatest democracy on earth provides almost all of the rights to citizens and foreigners alike. In fact you can complain to your local, state & federal lawmakers and they will help you in your problems.

    And yes a foreigner has the right to complain about any govt. organization including USCIS if their processes are adversely effecting him or her. These are the basic principles of the US democracy.

    Even though relatively US has one of the best functional govt.. sometimes it still takes lot of effort and time for the wheels to turn. Thats what IV is trying to achieve.

    Having said that I doubt any of this will penetrate your thick skull. Dard-e-disco you are basically a retard!

    I missed the boat in 2007. I think the bigger point here is that people vent their frustration of their GC journey only in a blog hiding their identity. When it comes to real work of meeting people, most hide under their bed..

    If the July 2007 fiasco hadn't happened, we wouldn't have had this mess. Most waiting on GC would have quit and gone home making the line shorter :rolleyes:

    I think even if the July fiasco wouldn't have happened we would have been in the same situation. Who would want to leave this country and go back. Many people who have applied in EB3 in 2004 -2006 know that they are stuck for another 6 - 15 years but they are still willing to wait.

    Visa numbers have been recaptured in the past (year 2000, I think).

    Do we know more details on how this happened? Who worked for this and what did they do to make their efforts successful?

    Same with the AC21 provision that allows changing jobs after 180 days. That is a huge accomplishment for whoever worked to make it happen.

    Perhaps we can borrow some of their wisdom.

    Sorry it is not really related to the thread !.

    Ths USCIS site says the following ....

    "....The current fee schedule will apply to all applications filed under Visa Bulletin No. 107 through August 17, 2007. (The new fee schedule that becomes effective on July 30, 2007, will apply to all other applications filed on or after July 30, 2007)."

    Does that mean if I file 485 on Aug1st I have to pay new fees?

    If extension has already been granted, it remains valid until it's expired, revoked by USCIS, revoked by employer or employer goes out of business. However, H1B status is technically lost (similary to the situation when h1b holder leaves the petitioner but petitioner never revokes h1). Even if USCIS does not revoke the extension, it will be investigated during new I-485 processing/H1 transfer or extension.

    If that is the case, then h1b is not an option at all.

    Hmmmm - but all these top Attorneys are professional - I mean - why would they tell you just the opposite for getting money through h1b transfers - I don't believe it.

    I did seek paid professional councel from Attorneys and thats how I was convinced that h1b is safer.

    Like say - of a h1b extension/transfer is successful - then the h1b is typically delinked from what is happening to 485 or 140. As per my understanding a pending 140 or a pending labor is the basis for h1b extensions and they are not coupled whereas an EAD is coupled with 485 and the denial hits the EAD straight because of its direct association.

    Folks correct me if I am wrong

    Don't get me wrong. There are so many good lawyers. I have talked to few of them who are reputed and didn't even charge me for my first call.     Just dont get what the senator is intending here ....

    Not sure if senator is missing it or dodging it ....

    The senator is missing it or dodging it - it clearly means one thing -we are invisible as constituents. We are being taken for a ride only because we do not speak up or go meet our lawmakers. They do not see us as ordinary constituents having the same issues as their other constituents. The whole human -angle is missing.

    We have to go meet our lawmakers and explain to them our part of the story/ They need to be told and made aware that we live in their constituencies and our grievances are genuine and need to be addressed.

    And although this particular bill does not affect people that are here already.. Beware!! the noose is tightening- the next on the chopping block is EB Immigrants.
